2. PURPOSE OF THE PROCESSING OF YOUR DATA
At Motor Cleb, we process the information provided by interested parties for the following specific purposes:
Rental service management: Processing of reservations, formalization of vehicle rental contracts, invoicing, collections, and deposit management.
Geolocation Management (Telemetry/GPS): Real-time vehicle tracking to guarantee asset security, prevent fraud, recover the vehicle in case of theft, and objectively verify compliance with express contractual prohibitions (access to circuits, off-road driving, or unauthorized border crossing).
Security and legal compliance: Communication of data to the State Security Forces and Bodies (SCOM - Mossos d'Esquadra) and management of sanction files before the DGT or local administrations.
Customer Service and Marketing: Responding to inquiries, complaints, or requests through the website, WhatsApp, or email. Sending commercial communications about services or fleets, only if the user has given express consent.
3. LEGAL BASIS OR LEGITIMATION FOR THE PROCESSING
The processing of your data is based on the following legal bases (Art. 6.1 GDPR):
Performance of a contract: For the management of reservations, the rental contract, and customer service.
Legal Obligation: For the communication of data to the Security Forces and Bodies in compliance with Royal Decree 933/2021, of October 26, as well as for compliance with fiscal and tax regulations.
Legitimate Interest: For the processing of the vehicle's geolocation data (GPS), balanced to protect the company's assets against theft or high-risk prohibited uses (e.g., circuits), as well as for video surveillance or recording the vehicle's condition at delivery/return.
Express consent: For sending newsletters or promotional communications.
4. RECIPIENTS AND DATA COMMUNICATION
Your data will not be sold or transferred to third parties for commercial purposes. They will only be communicated to third parties when strictly necessary or when there is a legal obligation:
Security Forces and Bodies (Mossos d'Esquadra / Police / Civil Guard): In strict compliance with RD 933/2021 on documentary registration of vehicle rentals.
General Directorate of Traffic (DGT) and Public Administrations: For driver identification in case of fines, sanctions, or unpaid tolls.
Insurance Companies and Loss Adjusters: For the management of policies, processing of accident reports, and settlement of claims.
Legal and tax advisors, and banking entities: For compliance with tax obligations and collection/deposit management.
5. CONSERVATION PERIODS
Personal data will be stored as long as the contractual relationship is maintained. Once finished, the data will remain duly blocked during the limitation periods of legal liabilities:
Tax and accounting data: 4 years (General Tax Law).
Traveler/vehicle registration data: 3 years (RD 933/2021).
Geolocation data: They will be deleted or anonymized once the rental contract is finalized and it is verified that there are no incidents, accidents, or non-compliances.
Civil/contractual liabilities: 5 years (Art. 1964 Civil Code).
6. RIGHTS OF THE DATA SUBJECT
Anyone has the right to obtain confirmation as to whether Motor Cleb is processing personal data concerning them. You may exercise the following rights at any time:
Access, Rectification, and Erasure: To know what data we have, correct it if it is inaccurate, or request its deletion when it is no longer necessary.
Restriction and Objection: To request that we limit the use of your data or to object to a specific treatment (for example, opting out of commercial mailings).
Data portability.
To exercise these rights, the data subject must send a written request to the email info@motorcleb.com, indicating "Data Protection" in the subject line and attaching a copy of their ID or equivalent document to verify their identity. Furthermore, we inform you that you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) through its website (www.aepd.es) if you consider that the processing does not comply with current regulations.
